Only the state of the item is considered, and as you pointed out, the
publication status ("Published", or "Live", or whatever we want to call it) is
*not* a Workflow state.

This means that an acceptable transition for an item which is not published is
"deactivate", and an aceptable transition for a published item is "Publish",
neither of which make any sense, I think. In fact in the current Globus
workflow-with-review.xml these transitions have conditions on them which cause
errors to be thrown.
